INFORMATION OF THE HOLDER AND RESPONSIBLE OF THE BANKS OF PERSONAL DATA

MERCATOR PERU – OPERADOR LOGISTICO S.A.C. (en adelante MERCATOR) con RUC No. 20602652204 con domicilio legal en CAL.MARTIN DE MURUA NRO. 187 URB. MARANGA ET. SIETE (PISO 4 – ALTURA CDRA 26 AV LA MARINA) LIMA – LIMA – SAN MIGUEL – PERÚ, es una sociedad inscrita en la Partida Electrónica No. 13977795 del Registro de Personas Jurídicas de la Oficina Registral de Lima, quien tiene como objeto social o actividades principales el dedicarse a la prestación de servicios consistentes en Agenciamiento Marítimo.

OBJECTIVE

Para MERCATOR es importante mantener y respetar la privacidad de sus datos personales y, por ende, proteger su información en cumplimiento de nuestras políticas corporativas, de lo establecido en la Constitución Política del Perú, así como en atención a lo dispuesto en la Ley de Protección de Datos Personales – Ley No.29733 y su Reglamento, aprobado por Decreto Supremo N°003-2013-JUS. Por ello brindamos a nuestros Usuarios la presente Política de Privacidad, en la cual se explica de forma clara y detallada cuales son nuestros procedimientos para recopilar, almacenar y tratar (utilizar) sus datos personales a consecuencia de la interacción que mantenga con nosotros, sea a través de nuestro sitio web: https://www.mercator.pe/ mediante la función de correo electrónico, mensajería instantánea (SMS, WhatsApp u otro), llamadas telefónicas, cookies u otros canales de titularidad de MERCATOR.

REGULATORY FRAMEWORK

This Privacy Policy is prepared in accordance with national legislation regarding the protection of personal data and in particular with the following legal instruments:

Political constitution of Peru.
Law no. 29733 – Law on the Protection of Personal Data.
Supreme decree NO. 003-2013-JUS – Regulation of the Law on Protection of Personal Data.
Directorial resolution NO. 02-2020-JUS/DGTAIPD – Directive for the Treatment of personal data through surveillance systems.

WHICH PERSONAL DATA DO WE COLLECT, STORE, AND WE TRY TO

MERCATOR realiza la recopilación, almacenamiento, tratamiento y la potencial transferencia nacional e internacional (flujo transfronterizo) de datos personales tales como: nombres y apellidos, Cargo, número de DNI, número de pasaporte, número de carné de extranjería, dirección del domicilio, teléfono, correo electrónico, profesión, entre otros que estén expresamente indicados en los formularios o formatos electrónicos, digitales y/o físicos que utilizamos para gestionar y obtener el consentimiento de los titulares de los datos personales.

En ese sentido, los datos personales que sean proporcionados libre y voluntariamente por los Usuarios (clientes, potenciales clientes o postulantes a un puesto de trabajo) en calidad de titulares de datos personales, facultarán a MERCATOR a utilizarlos para los fines de la actividad que desarrolla, para aquellos fines contemplados en la presente Política de Privacidad y para aquellos que en su oportunidad sean indicados en los formularios o formatos electrónicos, digitales y/o físicos mediante los cuales gestionaremos oportunamente la obtención del consentimiento de los titulares de los datos personales.

Transferir los datos de los Usuarios a terceros vinculados a MERCATOR, sean estos personas naturales o jurídicas, cuando ello resulte razonable y proporcionalmente necesario para la prestación de los servicios contratados.

WHAT ARE THE CONSEQUENCES OF NOT PROVIDING YOUR PERSONAL DATA

Como lo hemos mencionado anteriormente en la presente Política de Privacidad, los datos personales que requerimos de Usted son necesarios para cumplir cada una de las finalidades necesarias, por lo tanto, si decide no proporcionarnos su información personal y, por ende, negarnos su autorización para recopilar, almacenar, tratar y potencialmente transferirla, no será posible que MERCATOR pueda prestar los servicios que son de su interés y/o guardar su información personal para que pueda postular a un puesto de trabajo en nuestra compañía.

PERSONS OR ENTITIES THAT ARE RECIPIENTS OF YOUR INFORMATION

Para la comercialización de los servicios que ofrece MERCATOR en el mercado nacional e internacional y para el cumplimiento de las finalidades necesarias anteriormente indicadas en la presente Política de Privacidad, resulta imprescindible compartir todo o parte de sus datos personales con terceros vinculados a MERCATOR a nivel nacional e internacional y estos son:

Le informamos que la relación completa de las personas o empresas con quienes compartimos sus datos personales está detallada en el documento denominado “Entidades Receptoras de Datos Personales” – el cual está contenido en el Anexo I de la presente Política de Privacidad. Cabe mencionar que, de resultar necesario, la mencionada lista será oportunamente actualizada por MERCATOR utilizando esta misma vía.

Le informamos que sus datos personales serán almacenados en los Bancos de Datos Personales denominados “Trabajadores”, “Clientes” y “Proveedores” según corresponde, en sistemas automatizados y no automatizados, los cuales se encuentran inscritos en el Registro Nacional de Protección de Datos Personales con los códigos RNPDP-PJP No.15497, 15495 y 15496 respectivamente.

En ese sentido, le informamos que MERCATOR tiene implementadas todas las medidas técnicas, organizacionales, físicas y legales que resultan necesarias para garantizar el adecuado tratamiento de sus datos personales, la seguridad y confidencialidad de su información, que sus datos personales no serán accesibles y/o compartidos a terceros no autorizados, que se adoptarán todas las medias necesarias para evitar la alteración, pérdida, tratamiento y acceso no autorizado a los datos personales, ya que nuestro compromiso es custodiarlos con la debida diligencia y cumpliendo con las disposiciones legales vigentes en dicha materia.

In the case of the applicants for a job, your personal data will be stored for a maximum period of 02 (two) years and/or while the owner does not withdraw your consent.

RIGHTS OF THE HOLDER OF PERSONAL DATA

As we have mentioned earlier, the rights held by owners of the personal data is protected in the Political Constitution of Peru, the Law of Personal Data Protection, and its Regulations, and these are the rights of access, rectification, cancellation or opposition to the use or processing of your personal data, so that may be exercised at any time you deem appropriate and unrestricted (except for the cases provided for with exceptions by the Law of the matter).

AUTHENTICITY OF THE PERSONAL DATA PROVIDED

Los Usuarios declaran que todos los datos personales proporcionados son verdaderos, actualizados y exactos, por lo que MERCATOR no asumirá ninguna responsabilidad por aquella información que no cumpla con las mencionadas características y en especial, si su uso induce a error, en cuyo caso los propios Usuarios asumirán directa y personal responsabilidad por los perjuicios, reclamaciones, procesos, procedimientos administrativos y/o judiciales que puedan iniciarse a consecuencia de la información proporcionada por ellos, así como por los daños y perjuicios ocasionados.

CHANGES TO THIS PRIVACY POLICY – POLICY OF PROTECTION OF PERSONAL DATA

MERCATOR se reserva el derecho a modificar, actualizar o completar la presente Política de Privacidad en cualquier momento. Por lo tanto, cualquier cambio o modificación a la presente Política de Privacidad podrá realizarse en cualquier momento y será puesta en conocimiento mediante la publicación respectiva en la página web de la empresa y/o a través de los canales y/o procedimientos que estime convenientes para hacerlo de conocimiento de los Usuarios.
